Read carefully before submittingTerms of Application: By submitting this Trade Account Application, the applicant acknowledges and agrees to the following:
1. The information provided is true, accurate, and complete. Any false or misleading information may result in immediate rejection or cancellation of this application, without prejudice to any legal remedies available to B Shocked Electrical (Pty) Ltd.
2. All transactions are subject to strict Cash Before Delivery (CBD) payment terms. No credit, 30-day accounts, or deferred payment facilities are offered. No delivery will occur until full payment has been received and cleared.
3. All purchases are subject to B Shocked Electrical's Terms and Conditions of Sale, available at bshockedelectrical.co.za/pages/terms-and-conditions. The applicant confirms they have read and agree to be bound by these terms.
4. B Shocked Electrical reserves the right to accept or decline any application at its sole discretion, without being required to provide reasons.
5. A Trade Account does not constitute an obligation to supply any product at any particular price or timeframe. All pricing is subject to change without prior notice.
6. The applicant warrants that they are duly authorised to make this application on behalf of the entity named herein.
7. B Shocked Electrical may perform identity and business verification checks using information submitted, including contacting nominated trade references and conducting CIPC or other public registry searches.
Personal Suretyship

The individual completing this section binds themselves personally as surety for all obligations of the applicant entity.
1. Deed of Suretyship
I, the undersigned ("the Surety"), in my personal capacity and as duly authorised representative of the applicant entity named in this application ("the Principal Debtor"), hereby bind myself as surety and co-principal debtor, jointly and severally, in solidum, with and for the Principal Debtor, in favour of B Shocked Electrical (Pty) Ltd, Registration Number K2020235757 ("the Creditor"), for the due and punctual payment and performance of all present and future obligations of the Principal Debtor to the Creditor, arising from or in connection with this Trade Account application and any transactions concluded thereunder, including but not limited to: the purchase of goods, the obligation to take delivery of goods ordered, any obligation to return goods, and any liability arising from misrepresentation or fraudulent conduct.
2. Scope of Liability
My liability as surety shall extend to and include all amounts owing by the Principal Debtor to the Creditor from time to time, including the capital amount of any outstanding obligation, interest thereon (where applicable), and all legal costs on the attorney-and-own-client scale, collection charges, and any other costs incurred by the Creditor in enforcing this suretyship or recovering any amounts owed.
3. Renunciation of Defences
I hereby renounce and waive the benefits of the following legal defences, the full force and effect of which I declare myself to be fully aware of:
(a) Beneficium excussionis et divisionis — being the right to require the Creditor to first exhaust all remedies against the Principal Debtor before proceeding against me as surety;
(b) Beneficium ordinis seu excussionis — being the right to require the Creditor to first proceed against other co-sureties before proceeding against me;
(c) Beneficium divisionis — being the right to have the debt divided amongst co-sureties;
(d) The right to demand that cession of actions be provided to me prior to the Creditor enforcing this suretyship.
4. Continuing Guarantee
This suretyship shall be a continuing guarantee and shall not be discharged or affected by any granting of time, extension, indulgence, waiver, variation, novation, release, or any other act or omission by the Creditor in relation to the Principal Debtor or any other surety, whether with or without my consent, and whether or not it would otherwise have the effect of discharging my obligations as surety.
5. Certificate of Indebtedness
A written certificate signed by any director, manager, or duly authorised representative of B Shocked Electrical (Pty) Ltd, reflecting the amount owing by the Principal Debtor at any point in time, shall constitute prima facie proof of the amount owing for all purposes, including legal proceedings, in the absence of manifest error.
6. Binding on Successors
This suretyship shall be binding upon me and upon my heirs, executors, administrators, trustees, liquidators, business rescue practitioners, and successors in title.
7. Jurisdiction
I consent to the jurisdiction of the Magistrate's Court having jurisdiction over my person for the purposes of any legal proceedings arising from or in connection with this suretyship, notwithstanding that the amount in dispute may otherwise exceed the jurisdiction of that court. The Creditor retains the right to institute proceedings in the High Court of South Africa at its election.
8. Acknowledgement
I confirm that I have read and understood this deed of suretyship in its entirety, that I am signing it freely and voluntarily, that I have had the opportunity to obtain independent legal advice, and that I am duly authorised to bind myself personally in terms hereof.
